Brazilian footballer, Dani Alves, is currently dealing with serious legal consequences as he faces a potential prison sentence of up to 12 years. The allegations stem from an alleged sexual assault incident at a popular Barcelona nightclub, where a 23-year-old woman claimed that Alves raped her in one of the club's toilets. Since January 20, the 40-year-old former Barcelona and Paris Saint-Germain player has been held in custody at Brians 2.
Despite multiple attempts to secure his release on bail, Alves has been denied each time. Even his most recent appeal, which reached Barcelona's high court, was turned down. There are concerns that Alves might flee the country if granted release, potentially returning to his native Brazil, where extradition of its citizens is not possible.
According to a recent report from El Periodico, Alves' case has been assigned a trial date scheduled for the upcoming autumn. However, the specific timings have yet to be officially confirmed. If convicted, Alves could face a sentence ranging from six to 12 years, as the Law on the Guarantee of Sexual Freedom, which came into effect last October, applies to his situation.
In a television interview before his arrest, Alves claimed that he had never met his accuser. However, his stance changed after being apprehended, asserting that there was no assault and that the encounter was consensual. He maintains his innocence while admitting to infidelity in his marriage.
Initially, reports suggested that Alves was accused of inappropriately touching the woman inside the club, but later it emerged that she alleged he had slapped her and raped her in the toilet.
El Periodico reports that a panel of five judges, including two investigating judges and three magistrates, have examined the evidence on two occasions and have reached the same conclusion. Several indications apparently support the victim's claims while contradicting Alves' explanations.
Law enforcement discovered seven fingerprints belonging to the victim on the toilet cistern and sink, providing further support for her account. Additionally, footprints at the scene suggest movements that align with the two statements given by the accuser.
After being denied bail, Alves appeared on the Cuatro program 'En Boca de todos' and asserted, "Only two people know what happened and, above all, what didn't happen. I am telling the truth. I believe everyone understands that my initial statements were an attempt to salvage my marriage. That was my only motive, and I have nothing to hide. There are countless versions being discussed, but I have only testified twice before the judge. I have been in prison since January 20, and I have yet to stand trial. It will be proven that I am not guilty, and the relationship was consensual. It would never cross my mind to impose a sexual act on anyone."
Meanwhile, Alves' wife seemingly confirmed their separation through a post on social media. In a heartfelt handwritten letter, she expressed that it would take years to erase his piercing gaze from her memory and declared herself a strong woman moving forward into the next chapter of her life.
