Tragedy struck at Gillette Stadium in September when a New England Patriots fan, Dale Mooney (53), passed away following an altercation. Two Rhode Island residents, John Vieira (59) and Justin Mitchell (39), were recently charged with assault and disorderly conduct in connection with the incident.
Video footage captured by a bystander showed Mooney being punched in the face during the scuffle. He collapsed shortly after and was rushed to the hospital, where he sadly died. While the initial medical report indicated no signs of trauma, a deeper investigation revealed Mooney's pre-existing health conditions, including severe hypertension and cardiovascular disease.
The Medical Examiner ultimately ruled Mooney's death a "probable cardiac dysrhythmia" triggered by the physical altercation, classifying it as a homicide.
However, the District Attorney's office clarified that the available evidence, including video footage and witness accounts, did not provide sufficient grounds for homicide charges against Vieira and Mitchell.
"We appreciate the public's assistance in sharing video recordings and the efforts of the Foxborough Police Department in piecing together this heartbreaking incident," said District Attorney Michael W. Morrissey.
Vieira and Mitchell are scheduled to face arraignment in January 2024. Their legal representation could not be reached for comment at the time of publication.
