Two Nigerians have appeared before a Kenyan court, facing charges of defrauding a businessman in a questionable transaction amounting to Ksh60.4 million (Over $400,000).
The individuals, identified as Ali Ojo and Victor Nyekazi Wagwu, were brought before Milimani Magistrate Ben Mark Enhubi on allegations of cheating and unlawful presence in the country.
The alleged offense took place between January 20 and May 19, 2023, within Nairobi county.
Working together with accomplices yet to be apprehended, Ojo and Wagwu reportedly used deceitful methods to scam Noor Omar Ahmed out of USD 420,000.
The funds were intended for purchasing a reagent that would supposedly clear stamps on foreign currency funds Ahmed was due to receive from the sale of the Lisbon Hotel.
The suspects, Ojo and Wagwu, were apprehended near Bellevue Estate in Nairobi County at Rubis Petrol station. They were also found without valid passports or visas.
During their application for release on bond, the accused stated that they are Ugandan citizens and had entered Kenya for business purposes.
Ojo emphasized that he is married to a Kenyan and provided the presence of his wife and her parents in court as proof that he is not a flight risk.
Ojo expressed, "I am married to a Kenyan and my wife and her parents are in court to prove that I am not a flight risk."
He further appealed to the court to grant him bond, asserting that being a Nigerian is not a justifiable reason to deny him this opportunity.
Prosecutor Virginia Kariuki, on the other hand, opposed their release on bail, citing concerns that the two individuals could attempt to flee the country as foreigners residing in Uganda, who also hold Nigerian citizenship.
Kariuki informed the court that the police had verified that the accused lacked visas.
She argued that releasing them could lead to their evasion of the legal process.
The magistrate decided to keep Ojo and Wagwu in custody until August 18, when he will determine whether to grant them bond or not.
