The incident occurred on January 2, 2021, at the Boro Hotel in Long Island City, following a visit with friends.
The male and female victims, both 26 years old, have chosen to remain anonymous due to embarrassment and concerns for their safety.
The man described the terrifying ordeal, recounting how he opened the door expecting his food delivery, only to be confronted by two intruders who forced their way into the room and held him at gunpoint. Shockingly, he was unclothed at the time.
According to their lawsuit, the boyfriend had ordered a cake from a local bakery through Uber Eats but had fallen asleep before its arrival.
When he heard a knock on the door, he assumed it was the delivery person. Instead, the two assailants barged in, with one pointing a gun at the man's head while the other uncovered his girlfriend on the bed and tied her legs with the bedsheet.
The perpetrators proceeded to rob the couple of their wallets, jewelry, and sneakers before fleeing the scene.
The traumatized victims took a few minutes to gather their courage, dressed quickly, and rushed downstairs to the lobby, where they sought help from hotel staff.
Despite notifying the hotel's security guard and contacting the police, the couple felt that their concerns were not taken seriously.
The couple's lawsuit asserts that the hotel failed to provide adequate security and allowed the robbers to access their room without authorization.
The court documents state that the hotel "failed to exercise reasonable care" in protecting the plaintiffs and controlling the conduct of individuals on the premises.
As a result of the incident, the couple experiences ongoing psychological distress, including nightmares, rapid heart rate, and sweating.
Although the couple has stayed at other hotels since the incident, they still harbor residual fears and constantly check that doors are locked.
The girlfriend admits to regularly waking up from nightmares related to the incident, emphasizing that it was her first experience with such close proximity to a gun.
In response to the incident, the hotel offered the couple a free stay, which they declined.
They believe that measures need to be implemented to ensure the safety of future guests.
The couple's lawyer emphasized that the assailants were never apprehended, and the NYPD confirmed that no arrests had been made.
The couple is seeking unspecified damages in their lawsuit.
The hotel spokesperson has dismissed the claim as baseless, stating that they cooperated fully with law enforcement during the investigation and that such incidents had not occurred during their seven years of operation.
