Voicemail Confession: Indiana Man Convicted in Brutal Murder Case After He Mistakenly Recorded The Murder On Voicemail
A 33-year-old man from Indiana is facing a sentence that will likely keep him in prison for the rest of his life due to a fatal stabbing he committed in 2020.
Cody Allen Wade was sentenced by Clay County Superior Court Judge Robert A. Pell to 85 years in a state correctional facility for the murder of Carl Haviland, according to court documents reviewed by Law&Crime.
Wade was found guilty by a 12-person jury on several charges, including murder, resisting law enforcement, battery against a public safety official, and battery resulting in bodily injury to a public safety official.
Additionally, the jury determined that Wade was a habitual offender, leading to a sentencing enhancement.
Judge Pell, in a five-page sentencing order, highlighted Wade's extensive history of criminal behavior. On the day of the murder, Wade had already accumulated 12 prior criminal convictions and was on probation for arson.
The tragic incident occurred on June 18, 2020, when Wade left a cookout and expressed his intent to kill someone to a friend. Wade then proceeded to the residence where he and his mother lived.
While heading home, he attempted to leave a voicemail for his mom but inadvertently failed to disconnect the call before launching the attack on her boyfriend, Haviland.
Consequently, he unintentionally recorded the entire assault in a voicemail sent to his mother.
Judge Pell emphasized the brutal nature of the murder, where Wade repeatedly stabbed Haviland in front of his own mother, despite her efforts to intervene.
Wade also kicked and taunted Haviland during the attack.
Wade's motive for the murder stemmed from a belief that his mother had disrespected him.
Clay County Prosecutor Emily Clarke described the case as particularly disturbing due to Wade's inadvertent recording of the murder. The recording revealed taunting, racial slurs, and other offensive behavior by the defendant.
Haviland sustained four stab wounds during the incident.
Wade's sentence includes 60 years for murder, an additional 15 years for the habitual offender enhancement, and five years for each of the battery against a public officer charges, to be served consecutively.
The sentences for the remaining charges will be served concurrently.
