A jogger in California is accused of killing a homeless man who was sleeping on a sidewalk.
Craig Sumner Elliott, 68, was running with his dogs and pushing a cart on September 28th when he came across Antonio Garcia Avalos, 40, sleeping on the path.
Elliott reportedly nudged Avalos with his cart, waking him up. Avalos started yelling at Elliott, who began recording the interaction with his phone.
According to prosecutors, the video shows Avalos throwing a shoe at Elliott before Elliott pulls out a gun from his cart and shoots Avalos three times.
Elliott was arrested by police on November 17th in connection with the shooting.
He is charged with voluntary manslaughter and personal use of a firearm. If convicted, he could face up to 21 years in prison.
“This is a tragedy that could have been avoided,” said Orange County District Attorney Todd Spitzer. “Taking the law into your own hands is never the answer.”
Elliott has been released on bail and is scheduled to be arraigned on December 15th.
