An all-female jury reportedly felt sorry for Carey Birmingham and gave him a 10-year sentence instead of the 20 years prosecutors had requested.
Carey was caught on camera fatally shooting his wife in their driveway, yet he got only a 10-year prison sentence.
He will be eligible for parole in five years.
The 10-year sentence has caused outrage, with many believing it was too short, especially since it came from an all-women jury.
Carey Birmingham, 60, was caught on video, which his wife Patricia was recording, wearing only a robe and holding a shotgun aimed at her.
Patricia can be heard telling her husband, “You really want this on video,” to which he replied, “I’ll pull it, I’m man enough to pull it.”
Moments later, Birmingham fired the gun, hitting Patricia three times in the face.
The murder outside their Houston home was recorded on video.
Birmingham pled guilty.
He claims he was angry because he found out his wife was supposedly having an affair.
Her family says that’s not true.
Birmingham's defense lawyer, Anthony Osso, said they admitted guilt to the all-female jury to show that the shooting of Patricia happened in a sudden moment of anger.
Birmingham's lawyers argued that the defense wasn’t justifying the actions, but explaining why he did what he did.
Evidence was then shown to the all-female 12-member jury, which is unusual, to explain why he fatally shot his wife.
After reviewing the evidence, the jury reportedly felt sorry for Birmingham, giving him a 10-year sentence instead of the 20 years prosecutors wanted.
Jury consultant Jo-Ellan Dimitrius told Inside Edition that the all-female jury must have seen or heard something in the video that made them feel sympathy for Mr. Birmingham.
Mary Dees, the slain woman’s sister, says the family was shocked by the jury’s decision.
Dees told Inside Edition that she believes the jury was judging her sister and not the murder case.
As for the affair allegation, Dees says that authorities took her sister's computers and phones, but there was no proof that she was cheating.
The couple’s 18-year-old daughter, Olivia, spoke with Inside Edition.
“The love for my dad died that day. Even if he is still alive, when I look at him he is not the same person, and of course, he took my mom,” Olivia says.
