Kimberly Mollicone was in a relationship with another man while she was married. 

According to her husband, Matthew, this affair between his wife and her lover had gone on for over nine years.

Mathew said Kimberly and Daniel Giannone continued their relationship even after he found out about it.

Despite promises to end the affair, Kimberly continued her relationship with Daniel, causing tension between her and Matthew.

The Deadly Confrontation Caught on Camera

On July 12, 2022, the long-standing tension finally reached its breaking point.

Matthew confronted Kimberly again about her affair, asking if she was really committed to ending her relationship with Daniel.

When Kimberly did not provide a satisfactory answer, Matthew proposed they visit Daniel to end the affair in person. 

Kimberly agreed, and the couple drove to Daniel’s house that evening. 

When they arrived at Daniel’s home around 8:30 or 9 PM, the situation quickly escalated.

Daniel, who had been with his family, came out of his garage as Matthew and Kimberly approached.

What started as a confrontation turned deadly when both men drew their guns.

The entire altercation was caught on Daniel's Ring doorbell camera.

It captured the moment when Matthew fired his gun, wounding Daniel. 

In the chaos that ensued, Daniel returned fire, and Kimberly was tragically caught in the crossfire.

Investigation

The investigation into Kimberly's death was complicated by intense emotions and differing accounts of what happened.

Matthew was taken into custody and interrogated by the police in Macomb, Michigan.

During his interrogation, Matthew said he did not go to Daniel’s home with the intention of killing anyone. 

He maintained that the situation got out of control, resulting in a tragic outcome.

The police, however, were skeptical of Matthew’s account. 

They pointed out that he had brought a firearm and an extra magazine with him.

This suggested that he was prepared for a violent confrontation.

The Ring doorbell footage was a crucial piece of evidence that helped investigators piece together what happened that night.

The video showed the initial confrontation leading to the exchange of gunfire.

It also showed the moment Kimberly was shot while she and Matthew tried to flee the scene.

Matthew insisted he was not angry during the confrontation and only wanted to resolve the situation peacefully.

However, detectives found it hard to believe that a man who discovered his wife’s ongoing affair would not feel any resentment or anger.

The Courtroom Battle: Seeking Justice for Kimberly

Matthew Malecone was eventually charged with several serious offenses.

This included voluntary manslaughter, assault with intent to murder, and three counts of felony firearm possession. 

Matthew Mollicone was charged with the death of his wife Kimberly during the shootout for a few key reasons:

1. Matthew brought Kimberly to the confrontation at Giannone's home, putting her in a dangerous situation. Prosecutors argued he was responsible for her being there when the shooting started.

2. Matthew fired the fatal shot that struck and killed Kimberly as they were retreating in their vehicle, even though Giannone had also been shooting. The evidence showed Matthew's bullet was the one that killed her.

3. Giannone was acting in self-defense when he initially shot at Matthew after Matthew confronted him and reached for a gun. Matthew was the aggressor who instigated the confrontation.

So in summary, while Giannone's actions were a factor, the evidence showed Matthew was the one primarily responsible for the events leading to Kimberly's tragic death during the shootout he initiated. 

This is why he was convicted of voluntary manslaughter rather than Giannone.

During the trial, Matthew's defense attorneys tried to argue that Giannone should be charged with murder since he fired the actual fatal shot.

However, prosecutors successfully argued that Matthew was culpable for her death by bringing her to the scene and continuing to shoot at Giannone as they left.

Additionally, the prosecution argued that Matthew’s actions were driven by anger and a desire for revenge against Daniel and Kimberly. 

They said that Matthew had gone to Daniel’s home with the intent to confront him violently, which led to the fatal shootout.

The defense, on the other hand, argued that Matthew was a distraught husband who had been pushed to his limits by his wife’s infidelity. 

They claimed that Matthew had only intended to protect himself and his wife during the confrontation. 

Despite these arguments, the evidence presented in court told a different story. 

This included the Ring doorbell footage and Matthew’s statements during the police interrogation.

The jury found Matthew guilty of all charges, and he was sentenced to 86 months to 15 years in prison.
